New Details in Kidnapping of 10-Year-Old California Girl

In the early-morning hours of March 27,  a 10-year-old girl was kidnapped from her home near the Northridge campus of California State University. About 12 hours later, the redheaded girl was discovered walking barefoot in the parking lot of a shopping center near a Starbucks. Police say she was sexually molested after being abducted by two men with lengthy criminal records, one of whom — Tobias Dustin Summers, 32 — is still a fugitive at large.

Summers’s accused accomplice in the crime, 30-year-old Daniel Martinez, was arrested Sunday and appeared Wednesday at a court hearing in San Fernando where he pleaded not guilty to charges of kidnapping and burglary. The Los Angeles Times reports that Summers was also charged with multiple felonies:

Summers, 32, was charged in his absence with 36 counts of sexual assault as well as kidnapping and first-degree burglary, the Los Angeles County district attorney’s office said. If convicted, he faces multiple life terms in prison. …
The complaint alleges that Summers broke into the home and used a knife to abduct the girl. He is charged with committing numerous sexual acts on the child and taking nude photos of the girl. …
Martinez is not believed to have initiated the kidnapping or participated in the assault, authorities said.
Police said in a statement Wednesday that the girl was taken to an abandoned home in the neighborhood. …
Summers has convictions for receiving stolen property, grand theft, petty theft, possession of an explosive, and presenting false identification to police, according to records. In 2009, he was convicted of battery. Originally, he was also charged with annoying a child, but that charge was dismissed.
Between 2004 and 2012, Martinez was convicted of burglary, petty theft, grand theft, resisting a police officer, and unlawfully entering a property, according to records. In April 2012, he was convicted of making threats of death or great bodily injury.

Police said that the crime began as a “hot prowl” burglary that escalated. Authorities have widened their search for Summers to the San Diego area, where the fugitive suspect has reportedly been sighted.
