Progressive Activist Brett Kimberlin Charged With Sex Offense

Brett Kimberlin, the convicted bomber-turned progressive activist, had sex with his wife when she was only 15, according to charges filed Monday in Maryland. A native of Ukraine who is now estranged from her husband and seeking a divorce, 32-year-old Tetyana Kimberlin says she had sex with Kimberlin multiple times during her 1996 visit to the United States, before she turned 16, the legal age of consent in Maryland.

At the time of the alleged offense, Kimberlin was on parole from federal prison for a 1978 bombing spree that terrorized the Indianapolis suburb of Speedway. In 1981, he was sentenced to 50 years in prison. A convicted marijuana smuggler, Kimberlin gained notoriety in 1998 by claiming to have once sold marijuana to then-Vice President Dan Quayle. Kimberlin was released in 1993, but was sent back to prison in 1997 for failing to pay a wrongful death claim by survivors of one of his victims, Vietnam war veteran Carl DeLong. Kimberlin was released from prison again in 2001, having served 17 years of his original sentence.

In accusing Kimberlin of a third-degree sex offense, Tetyana says she met him when she was 14 and living in Ukraine, where Kimberlin traveled on business after his 1993 parole. In charges filed Monday with the Montgomery County District Court, Tetyana says she was 15 when she arrived in Maryland in September 1996 and that Kimberlin, who was 42 at the time, had sexual intercourse with her repeatedly before her 16th birthday in November of that year.

Kimberlin is head of two progressive non-profit groups, the 501(c)3 Justice Through Music Project and the 501(c)4 group Velvet Revolution. The latter group made headlines with accusations of wrongdoing against Karl Rove, the U.S. Chamber of Commerce, Supreme Court Justice Clarence Thomas and the late conservative media entrepreneur Andrew Breitbart. In May 2012, claims that Kimberlin was responsible for the harassment of conservative bloggers inspired “Everybody Blog About Brett Kinberlin Day.”

Kimberlin’s sexual interest in young girls had already been widely reported before the charges filed by his estranged wife Monday. A 1981 article in the Indianapolis Star reported that investigators believed the bombing spree that led to Kimberlin’s imprisonment began as a plot to distract attention from the murder of Julia Scyphers. A 65-year-old housewife, Scyphers was the grandmother of a young girl toward whom Kimberlin reportedly showed a “strange affection.” In his 1996 book  Citizen K: The Deeply Weird American Journey of Brett Kimberlin, journalist Mark Singer recounted how Kimberlin took the little girl on “just the two of them” vacations for three consecutive summers beginning when the girl was 10. Syphers, who objected to Kimberlin’s relationship with her granddaughter, was shot dead in July 1978, a crime that remains officially unsolved.

Kimberlin actually spoke of his sexual interests in 1996, when he was pursuing a rock music career. Kimberlin released an album, and was featured in the Washington City Paper:

Not all the songs on his album … have political overtones … others, like “Waiting to Meet” and “Teen Dream” (both about having sex with teenage girls) are lacking in subtlety and tend to make one squirm. But this is exactly what Kimberlin wants.
“I say things a lot of people are afraid to say. Yeah, ‘Teen Dream’ is about f-king a teenage girl. Every guy who’s seen a good-looking teenage girl has thought about it. I’m talking about that lecherous quality that every man, though he won’t act on it, has.”

Just months after that February 1996 interview, according to the charges filed Monday, Kimberlin “enticed me to come to Maryland so I could be his sex partner and bride,” Tetyana Kimberlin wrote. “Brett Kimberlin had sex with me every single day between the day I arrived and the day I turned sixteen, on Nov. 16, 1996.” Tetyana wrote that her cousin, who was 12 at the time, “also met Brett Kimberlin in Ukraine and came to live with him … shortly before I did. On at least one occasion, I saw him attempt to seduce her.”

Both Kimberlin and his wife were in Maryland District Court for a hearing Monday in regard to his peace order petition against her. Earlier this month, Tetyana Kimberlin claimed her estranged husband had threatened her:  “He told me if I will try to take my kids with me he will hurt me and I will see what will happen to me. … He tells my 14-year-old about his plans about me and what he is going to do with me.”

The latest allegation in the case were first reported by blogger John Hoge, who also reports that Brett Kimberlin apparently forged Ukrainian documents to show Tetyana’s age as two years older, although Kimberlin had previously used Tetyana’s correct birthdate (Nov. 16, 1980) in his court actions against her. Kimberlin, a convicted perjurer, was arrested in 1978 for attempting to forge U.S. government documents, as the Indianapolis Star reported.

      Hi Schmalfeldt! Mark Singer interviewed people who previously dealt drugs with Brett Kimberlin for his book "Citizen K." Dude, he managed to make drug dealers uncomfortable by referring to 12 year old Jessica Scypers (not her real name) as "His girlfriend." Yes, even drug dealers found this creepy.
